In what cases can I file a complaint against the Pension Fund?

Based on the information indicated on the PFR website, citizens can file a complaint against the Pension Fund in the following cases:

  • violation of the deadlines for registering an application or providing public services;
  • refusal to accept documents;
  • refusal to provide public services;
  • refusal to correct errors and/or typographical errors in issued documents;
  • requirement for documents not provided for by regulatory legal acts;
  • requiring payment for the provision of free public services.

How to write a complaint to the Pension Fund?

Like any other official appeal, a complaint against the FIU is written in an arbitrary form. However, at the same time, do not forget about the basic rules for conducting business correspondence: your statement should be concise and restrained, without unnecessary emotions and strictly to the point. The content depends on the specific situation, but regardless of the subject of your appeal, the complaint must contain the following information:

  • the name and address of the authority to which you are applying (this information can be found on the official website of the Pension Fund of the Russian Federation);
  • your data (name, address, contact phone number);
  • the essence of the complaint (describe the actions of the FIU employees that infringed on your legitimate rights and interests);
  • your requirements (write what you want to receive as a result of the complaint);
  • list of attached documents;
  • date and signature.

Where to file a complaint against the Pension Fund?

First of all, we recommend that you file a complaint with the head of the PFR Department: general rule Your request must be answered within 30 days. If this did not happen or the measures taken by the head of the department seem insufficient to you, you have several options: file a complaint with a higher branch of the Pension Fund, the prosecutor's office or the court.

Regardless of the reason for the submission of an official paper, it must be considered within 10 days. The specifics of how to write an application to the pension fund depends on the reason for the application. The general scheme is as follows:

Each application must contain full information about the person and the purpose of his appeal.

When choosing a basis, it is necessary to indicate in the application a request for:

  • appointment of an insurance pension,
  • assigning a share of the old-age insurance pension,
  • appointment funded pension.

The insurance part can be with the establishment of a fixed payment for age, disability or loss of a breadwinner. The features of the funded pension are also prescribed. If maternity capital was involved, there is investment income, this is indicated.

Application for an old-age pension

It is submitted to the territorial authority upon reaching the age limit specified in the legislation and in the presence of seniority. There are no time limits for the submission of an official paper, but the date on which the application was submitted is considered the start date of the appointment.

Any citizen of Russia has a close relationship with the FIU (as a payer of insurance premiums or a recipient of a pension), but there may come a time when you have to apply to the pension fund with a complaint, a sample of which is also not so easy to find on the Internet. How to do it right? Where should you start? The following is a step-by-step discussion of these and similar issues.

Who is the recipient

A complaint to the pension fund must be submitted to the territorial office at the place of registration. The appeal is written to the head of this structure. The correct name of the body can be found on the foundation's website. If the actions of the head of the department are appealed or the answer received is not satisfactory, the issue can be resolved through a higher organization.

The headline should be "complaint", not "statement". The regulatory authorities have 30 days to respond to a simple appeal, while the time to process a complaint about the provision of a service will be only 15 (from the day following the date of registration). In some cases, the review period is reduced to 5 days.

Arguments

The appeal should detail which rights of the applicant have been violated by the regulator. If possible, make a reference to regulatory documents indicating the illegality of his actions. The mention of specific legislative acts will demonstrate the applicant's awareness of legal issues and will not allow the official to interpret the norms at his own discretion. If supporting documents are available, copies must be made and attached to the appeal. In the list, indicate the number of copies and sheets in each of them.

General rules for correct application to the Pension Fund

You can complain about the actions of the Pension Fund of the Russian Federation in the following cases:

in case of violation of the registration period of any request and application;

in case of violation of the term of appointment and recalculation of the pension;

when employees of the Pension Fund of the Russian Federation require documents that are not provided for by regulatory legal acts of the Russian Federation;

when employees of the Pension Fund of the Russian Federation refuse to accept documents from a citizen;

in case of illegal refusal to assign and recalculate a pension;

when requesting payment for services;

if the territorial body of the Pension Fund of the Russian Federation refuses to correct the typos and errors in the issued pension documents.

How to apply to the Pension Fund of the Russian Federation
